Delight as Judge Throws Out Legal Challenge to Consented 10,000-Home Scheme

UK Property Forums22 September 2025

A High Court challenge to the consented 10,000-home Harlow & Gilston Garden Town has been dismissed.

East Herts Council approved the scheme in January. It includes 2,300 affordable homes, seven new primary schools and two new secondary schools, and is expected to bring more than £1.3 billion of investment to the area. The claimants sought to overturn the approval on nine wide-ranging grounds, all of which were rejected by Justice Lang.

Cllr Vicky Glover-Ward, East Herts Council's executive member for planning and growth, welcomed the ruling. She said the council and its Garden Town partners had worked for many years to reach approval, and hoped the judgment would end delays to much-needed housing, including homes for people struggling to get onto the property ladder. She added that the development will also deliver infrastructure, jobs, leisure and community facilities including healthcare.
